Corporate or company law serves to govern the formation and operations of companies and their interaction with shareholders, creditors and government. The Companies Act, 2008 seeks to, inter alia, promote compliance with the Bill of Rights, the development of the economy, balance the rights and obligations of shareholders and directors and to provide for efficient rescue and recovery of financially distressed companies. Commercial Law is the body of law which regulates and develops the business world i.e. contracts, companies, partnerships, insolvency, labour law, tax law, shipping law and competition law.
