Arbitration and mediation are procedures whereby the parties agree to private dispute resolution as opposed to going to court. Arbitration is very similar to court proceedings and arbitrators hear the dispute in a manner that can be compared to a trial. It is mainly regulated by the Arbitration Act, 1965.
Mediation is a more informal procedure whereby the dispute is settled with the assistance of a neutral third party and only resolved when all parties agree. The Court-Annexed Mediation Rules makes provision for the referral of disputes for mediation at any stage during civil proceedings, provided that judgment has not been delivered by the Presiding Officer.

Leana Badenhorst is an experienced advocate with a strong background in dispute resolution, insolvency law and commercial litigation. She holds an LLB and has been a member of the Pretoria Bar since 2003, returning to active membership in 2007.
Before joining the Bar, she completed her candidate attorney training at Rob Megaw Attorneys in Pretoria. Over the course of her career, she has been involved in a number of significant matters before the Constitutional Court and Supreme Court of Appeal, including landmark decisions relating to parole rights, conveyancing disputes and insolvency law.
Leana has extensive experience in arbitration and mediation and currently serves as a Mediator, Arbitrator and Acting Judge. She is also a panel member of the Arbitration Foundation of Southern Africa, where she acts as both Arbitrator and Mediator.
She is recognised for her analytical approach, practical legal insight and strong dispute resolution skills across a range of commercial and family law matters.
